We are strongly committed to protecting your personal data. Your data is therefore exclusively processed based on the legislative regulations (GDPR, TKG 2003). This data protection notice will provide you with information on important aspects of data processing within the scope of our web site.

Contacting us
Whenever you contact us either via a website form or via email, the data you provide is stored to enable us to answer your query and to be able to follow-up with any subsequent questions you may have. This data will not be passed on to third parties without your consent.

Cookies
Our web site uses so-called cookies. These are small text files that are stored on your device using the browser. They do not cause any damage. We use cookies to make our offer user-friendly. Several cookies remain stored on your device until you delete them. The enable us to recognize your browser when you visit us again. If you do not wish this, you can change the settings in your computer so that it informs you when cookies are to be stored and you can permit this individually. Deactivation of cookies may limit the functionality of our web site.

Web analysis
This web site uses Google Analytics, a web analysis service offered by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google“). Google Analytics uses a specific form of cookies (text files) that are stored on your computer and which enable the analysis of the way you use our web site. The information generated by these cookies about your use of this web site is normally transmitted to a Google server in the USA and stored there. Google uses this information at our request to evaluate your use of the web site, to compile reports about web site activity and to provide further services associated with web site and internet use to the web site owner. The IP address transmitted from your browser within the scope of Google Analytics is not linked with other data available to Google. IP anonymization
We make use of the “activate IP anonymization” function on the web site. This means that your Google IP address is shortened within EU member states or in other contractually-bound states beyond the European Economic Area. The full IP address is only transmitted to a Google server in the USA in exceptional cases and shortened there. Google uses this information at our request to evaluate your use of the web site, to compile reports about web site activity and to provide further services associated with web site and internet use to the web site owner. The IP address transmitted from your browser within the scope of Google Analytics is not linked with other data available to Google. The relationship to the web analysis provider is based on the European Commission’s adequacy declaration C (2016) 4176 (EU-USA: “Privacy Shield”). The processing of data is done based on the legal requirements of § 96 (3) TKG and of Art 6 (1) lit (a) (consent) and or (f) (justified interest) of the GDPR. Our concern related to the GDPR (justified interest) is the improvement of our offer and the user experience of our web site. Since the privacy of our users is very important to us, the user data are anonymized.

Newsletter
You have the possibility of subscribing to a newsletter via our web site.  To this aim, we need your email address and your declaration that you agree to receive the newsletter. In order to be able supply you with targeted information, we also collect and process information regarding the areas you indicated interested in, location of the company, etc. As soon as you have subscribed to the newsletter, we send you an email with a link to confirm the subscription. The newsletter subscription can be cancelled at any time. Simply send your cancellation email to office@delimax.at. We will then delete your data associated with the newsletter subscription.

Double opt-in and documentation
Subscribing to our newsletter is achieved via a so-called double opt-in process. This means that you will receive an email after opting to subscribe asking you to confirm your registration. This confirmation is necessary to prevent third-parties from signing others up to subscriptions. The newsletter registrations are documented in order to be able to prove that the registration process complied with the legal requirements. This involves storing the time and date of the sign-up and confirmation together with the IP address. Changes to the data stored by CleverReach are also documented.

Use of the mailing service provider “CleverReach”
The newsletter is distributed using the “CleverReach” newsletter mailing platform, provided by the company CleverReach GmbH & Co. KG in Mühlenstraße 43, 26180 Rastede, Germany. The email addresses of our newsletter recipients as well as further data described in the scope of this notice are stored on servers belonging to CleverReach in Germany. CleverReach have been contracted by us to use this data for the distribution and evaluation of the newsletter. Furthermore, according to CleverReach, they can use this data to optimize or improve their own services, for example for the technical optimization of the distribution and the layout of the newsletter, or for commercial purposes to determine which countries the recipients originate from. However, CleverReach does not use our newsletter recipient’s data to write to them or pass it on to third parties. We trust the reliability and the IT and data security provided by CleverReach. CleverReach has obligated itself to complying with the EU data protection regulations. Furthermore, we have signed a “contract for the contractual processing of person-related data (according to GDPR09”. This is a contract whereby CleverReach commits to protecting our client’s data, to process the data on our behalf in accordance with the client’s data protection regulations and, in particular, not to pass on the data to third parties.

Statistical surveys and analyses
The newsletters contain a so-called “web beacon”, i.e. a file the size of a pixel, that is invoked by CleverReach’s server when the newsletter is opened. This invocation results in technical information regarding browser and your system, your IP address and the time and date when the beacon was activated. This information is used to improve the technical aspects of the service using the technical information of the target groups and their reading behaviour regarding the location of the reader (identifiable via the IP address) and the access times. The statistical survey also includes whether the newsletter could be opened, when it was opened, and which links were clicked. For technical reasons, this information can be linked to the individual newsletter recipient, however, it is neither our nor CleverReach’s intention to observe individual newsletter recipients. The evaluation is rather used to help recognize our reader’s reading habits and to adapt our content or transmit different content according to our user’s interests.

Online invocation and data management
There are cases where we redirect the newsletter recipient to CleverReach’s web pages. For example, our newsletter contains a link with which the newsletter recipient can open up the newsletter online (for example, should the newsletter not display correctly in the email program). In this context, we inform the user that the CleverReach web site uses cookies and thus person-related data can be processed by CleverReach, their partners and service providers (e.g. Google analytics). We have no influence on this form of data collection. Further information can be obtained in CleverReach’s data protection declaration. Legal basis data protection regulation
In accordance with the GDPR requirements valid from 25 May 2018, we hereby inform you that the consent regarding the sending of email address is based on article 6 paragraph 1 (a), 7 GDPR and § 7 paragraph 2 No. 3 and paragraph 3 UWG. The use of the mailing service MailChimp, execution of statistical surveys, analysis and documentation of the registration procedure are based on our justified interest according to article 6 paragraph 1(f) GDPR. Our interest is focussed on the usage of a user-friendly and secure newsletter system that both serves our business interests and corresponds to the expectations of our users. We inform you further that you can object to the future processing of your personal data according to the legal regulations in accordance with article 21 GDPR at any time. The objection can be directed in particular against the processing for the purposes of direct marketing.

Duration of storage for your data
The data you make available to us is only stored for as long as needed to fulfil the corresponding purpose for which you divulged the data or for as long is required to comply with legal requirements. In as far as you have explicitly consented to the use of your personal data for marketing purposes (registration to the newsletter), we use your data for this purpose for as long as you do not withdraw your consent. You can withdraw your consent at any time for effect in the future.

Limited disclosure
It may be necessary for DELIMAX to disclose your personal data to connected companies or external service providers that act exclusively on our behalf to process your request. Such service providers could be, for example, those contracted to distribute the newsletter. DELIMAX demands that all connected companies and external service providers use your personal data exclusively for our purposes and in compliance with this data protection notice and in accordance with the legal requirements for subcontracted data processing. In general, we will not pass on, sell or rent your personal data to third parties without your explicit request.

Your rights
You have fundamental rights regarding information, correction, deletion, limitation, data portability, revocation and objection. If you believe that the processing of your data violates the data protection regulation or your data protection rights in any form, you can complain to the regulatory authority.
